On Tuesday, the Supreme Court ruled that the West Bengal government cannot stop women doctors from working night shifts. A bench led by Chief Justice DY Chandrachud, along with Justices JB Pardiwala and Manoj Mishra, made this statement while reviewing the state government’s order to restrict women from working more than 12 hours and in night shifts. This discussion arose during a hearing related to the shocking rape and murder of a trainee doctor from RG Kar Medical College and Hospital in Kolkata.
The Supreme Court questioned the validity of the notification issued by the West Bengal government that limits women from working during night shifts. The case, connected to the recent tragic incident involving the trainee doctor, has sparked debate over the rights and protection of women in the workplace.
Senior advocate Kapil Sibal, representing the West Bengal government, informed the court that this ban is temporary and part of the state’s efforts to safeguard working women following the incident. Sibal assured that the restriction will be lifted soon, as the government is looking into additional protective measures for women workers.
The court emphasized that women do not seek special exemptions, but rather equal opportunities. The bench pointed out that women doctors are prepared to work under any conditions and that it is the state’s duty to ensure their safety. The Supreme Court’s ruling reinforces the right of women to work freely and safely without being subjected to discriminatory regulations, regardless of the tragic events that have occurred. The court’s decision is expected to guide future policies on gender equality and workplace safety in India.
