Supreme Court Stays Lokpal’s Order on Complaint Against High Court Judge

The Supreme Court today put a stay on the Lokpal’s decision to entertain complaints against a sitting High Court judge, calling it a disturbing move that could affect judicial independence. A special bench led by Justice B.R. Gavai issued notices to the Centre, the Lokpal Registrar, and the complainant while seeking their responses. The bench also included Justices Surya Kant and Abhay S. Oka.

Solicitor General Tushar Mehta, representing the Centre, argued that High Court judges do not fall under the Lokpal and Lokayukta Act, 2013. The bench directed that the judge’s name remain confidential and ordered the complainant not to disclose any details publicly. The Supreme Court took suo motu cognizance of the Lokpal’s January 27 order and initiated proceedings.

Justice Gavai stated, “Notices should be issued to the Union of India, the Lokpal Registrar, and the complainant.” The court also instructed the Registrar (Judicial) to ensure the complainant’s identity remains confidential.

The case will be heard again on March 18. The Lokpal’s order was based on complaints alleging that a High Court judge influenced a case in favor of a private company, which was previously his client when he was a lawyer.
