The Supreme Court expressed its strong disapproval towards yoga guru Ramdev and Acharya Balakrishna, the Managing Director of Patanjali Ayurveda, for failing to file a proper affidavit of compliance in a misleading advertisement case. The court termed their actions as “complete negligence beyond all bounds” and rejected Balakrishna’s statement that the Drugs and Cosmetics (Magic Remedies) Act was outdated.
A bench comprising Justices Hima Kohli and Ahsanuddin Amanullah reprimanded Ramdev and Balakrishna for their disregard towards court orders, emphasizing the importance of respecting judicial decisions across the country. The bench criticized their failure to abide by the court’s directives, stating, “You have broken all limits.”
Expressing surprise at Patanjali’s claims against allopathy’s efficacy in treating Covid-19, the court urged the central government to take notice of the matter and demanded an unconditional apology from the defendants. Solicitor General Tushar Mehta offered assistance in resolving the issue between the parties.
Justice Kohli admonished Balakrishna’s counsel for failing to ensure the proper filing of the compliance affidavit as per the court’s instructions. Despite the counsel’s request for additional time, the bench emphasized the need to conclude matters promptly. Ramdev and Balakrishna were given a week to file the necessary affidavits.
The court scheduled the next hearing for April 10 and directed both Ramdev and Balakrishna to be present. The decision came after the bench took note of their failure to respond to a court notice issued earlier. The court had previously issued a ‘show cause’ notice to Ramdev, considering the advertisements released by Patanjali as the subject of an affidavit filed in November 2023.
During the proceedings, Balakrishna tendered an unconditional apology to the Supreme Court for the misleading advertisements of Patanjali Ayurveda products. Patanjali Ayurveda Limited had previously assured the court that it would adhere to all laws, particularly those related to advertising or branding of its products.
The court’s stern stance underscores the importance of compliance with legal obligations and respect for judicial processes. Ramdev and Balakrishna’s appearance in court signals a pivotal moment in the ongoing case, emphasizing accountability in advertising practices and upholding the integrity of the legal system.
