Supreme Court Orders Strict Enforcement of GRAP-IV to Control Pollution

The Supreme Court today directed Delhi and NCR states to immediately form teams to enforce restrictions under the Graded Response Action Plan (GRAP-IV). The court emphasized that these measures should remain in place even if the Air Quality Index (AQI) drops below 450.

A bench comprising Justice Abhay A. Oka and Justice Augustine George Masih stated that ensuring a pollution-free environment is a constitutional duty of all states. The bench called for strict action to address violations and recommended establishing a system for lodging complaints related to breaches of GRAP-IV restrictions.

Delhi and NCR States Must Submit Action Plan

The court directed the Delhi government and neighboring NCR states to file an affidavit by November 22, detailing steps taken to combat pollution and comply with GRAP-IV measures. The bench also noted that states could adopt additional measures beyond GRAP if necessary.

The bench questioned the delay in implementing GRAP phases and sought explanations from the Delhi government and the Commission for Air Quality Management (CAQM). Delhiā€™s counsel informed the court that GRAP-IV was implemented on Monday, including a ban on heavy vehicles entering the national capital.

The court urged swift action to protect citizens from worsening air pollution.
