Supreme Court Allows Candidates with 40% Disability to Pursue MBBS

The Supreme Court today ruled that a 40% physical disability does not automatically disqualify a person from pursuing medical education, provided the expert report does not prevent the candidate from studying MBBS. A bench consisting of Justice BR Gavai, Justice Arvind Kumar, and Justice KV Viswanathan explained the reasons behind its September 18 decision.

Last month, the Supreme Court allowed a candidate with a 40% disability to take admission into an MBBS course after receiving approval from the medical board. The board determined that the candidate could successfully complete the course without any issues.

The bench stated that in cases where a candidate is disabled, their ability to pursue an MBBS course will be assessed by the Disability Assessment Board. The court emphasized that disability alone should not be a barrier to education if experts find the candidate capable of completing the program.
